Terms and Conditions of Sale
Last updated: 18 October 2026
This English version is provided for convenience; the French version prevails.
1. Scope
These terms apply to the services of Delphinium (trading name: Delphinium Interactive, SAS (French simplified joint-stock company), 47 rue Vivienne, 75002 Paris, France, Paris Trade and Companies Register (RCS) 107 178 824): creation of 3D configurators, 3D modelling, e-commerce integration and maintenance.
They are reserved for businesses. Delphinium does not sell to consumers.
They are provided before any order is placed (Article L441-1 of the French Commercial Code) and prevail over any other document, unless otherwise agreed in writing.
2. Offers and prices
The offers below are indicative. Only the signed quote is binding.
- Pro, from €1,290 excl. VAT: 1 configurable product, 8 variants, essential interactions, iFrame or glTF integration, 1 round of revisions. Indicative lead time: about 2 working weeks.
- Premium, from €1,690 excl. VAT: bespoke scene, 16 variants, animated transitions, mobile augmented reality, 3 rounds of revisions. Indicative lead time: about 3 working weeks.
- Maintenance, €79 excl. VAT per month: platform compatibility, minor adjustments, priority support.
The following are excluded from maintenance: a new product, a structural redesign, a non-standard technology. They are covered by a separate quote.
Maintenance may be cancelled with one month's notice. The current month remains payable.
A founder rate is reserved for the first five partner clients. It is kept for as long as their subscription is active. Price increases apply only to new clients.
3. Orders
The order is concluded by a quote dated and signed by the client. The quote is valid for 30 days.
Prices are in euros, exclusive of tax. VAT is added at the rate in force.
4. Payment
- A 30% deposit is due on signing the quote.
- The 70% balance is due on delivery.
- Invoices are payable within 15 days of their date.
No discount is granted for early payment.
In the event of late payment, penalties are due automatically. Their rate is the rate applied by the European Central Bank to its most recent refinancing operation, plus 10 points. A fixed indemnity of €40 for recovery costs is also due (Articles L441-10 and D441-5 of the French Commercial Code).
5. Client obligations
The client supplies the necessary materials in good time: high-definition photographs, 3D or CAD files, brand guidelines, list of variants, access to their e-commerce platform.
Lead times run from receipt of the complete materials. Any delay on the client's part extends Delphinium's lead times accordingly.
6. Revisions
The number of rounds of revisions included depends on the offer chosen. Any additional revision is covered by a supplementary quote.
7. Delivery and acceptance
Delivery is made by an integration link (iFrame). Depending on the project, it also includes a glTF file on request, an augmented reality link and documentation.
The client checks the delivery. Without a written and reasoned reservation within 8 days, the delivery is deemed accepted.
8. Intellectual property
Upon full payment, Delphinium assigns to the client the rights of use in the specific deliverables, for the use set out in the quote.
Delphinium remains the owner of its tools, know-how, libraries and generic code.
Delphinium may cite the project as a reference, unless the client refuses in writing.
9. Third-party services
Some configurators rely on third-party services, for example Vectary. Their availability depends on these providers. Delphinium has no control over their interruptions.
10. Liability
Delphinium is bound by an obligation of means.
Its liability is limited to the amount, exclusive of tax, paid by the client for the service concerned. Delphinium is not liable for indirect damages.
11. Force majeure
Neither party is liable for a failure caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code. The obligations concerned are suspended for the duration of the event.
12. Confidentiality
Each party keeps confidential the non-public information received from the other in connection with the service. This undertaking applies during the service and after it ends.
13. Personal data
The processing of personal data is described in our privacy policy.
If Delphinium processes personal data on behalf of the client, the parties sign a data processing agreement compliant with Article 28 of the GDPR.
14. Termination
In the event of a serious breach by one party, the other may terminate the contract. It must first send a formal notice that has remained without effect for 15 days.
15. Governing law and disputes
These terms are governed by French law.
In the event of a dispute, the parties first seek an amicable solution. Failing that, the courts of Paris have exclusive jurisdiction.
